By accessing our website or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use our website or purchase our products.

These Terms are subject to your rights under applicable South African consumer-protection legislation. Nothing in these Terms is intended to remove or limit any right that cannot legally be excluded.

2. USING OUR WEBSITE

You agree to use the Soleify website lawfully and responsibly.

You may not:

We reserve the right to restrict or terminate access to our website where reasonably necessary to protect our business, customers or website.

3. PRODUCTS

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and other information displayed on our website are accurate.

However, colours may appear slightly different depending on your device, screen settings and other technical factors.

Product availability may change without notice.

We reserve the right to:

  • Correct errors in product descriptions
  • Correct pricing errors
  • Update product information
  • Limit quantities available for purchase
  • Discontinue products

Nothing in this section limits any consumer rights you may have under applicable law.

4. PRICES

All product prices will be displayed on the website at the time of purchase.

Any applicable delivery charges or other additional costs will be displayed before you complete your order, where applicable.

We will not intentionally charge you a price higher than the price displayed for the product at the time of purchase, subject to correcting obvious pricing errors in accordance with applicable law.

ECTA requires online suppliers to make the full price of goods available, including applicable transport costs, taxes and other fees or costs.

5. ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

After receiving your order, we will provide confirmation of the order and relevant transaction information.

An order may be cancelled or rejected where reasonably necessary, including where:

  • A product is unavailable
  • There is an obvious pricing or product-description error
  • We reasonably suspect fraudulent activity
  • Technical problems have affected the order
  • We are unable to fulfil the order

If we cannot fulfil an order after payment has been received, we will notify you and provide an appropriate refund in accordance with applicable law.

6. PAYMENT

We accept the payment methods displayed at checkout.

Payment must be successfully completed before an order is processed, unless we expressly agree otherwise.

Payment processing may be handled by third-party payment providers.

We do not intentionally store complete payment-card information on our own systems.

We may take reasonable measures to prevent fraudulent or unauthorised transactions.

7. DELIVERY

We will endeavour to dispatch and deliver your order within the delivery timeframe displayed on our website or provided to you at checkout.

Delivery times may vary depending on:

  • Your location
  • Courier availability
  • Public holidays
  • Weather
  • Unforeseen circumstances
  • Other circumstances outside our reasonable control

If we are unable to fulfil an order within the agreed period, your rights under applicable law will apply.

ECTA generally requires an online supplier to execute an order within 30 days unless another period has been agreed with the consumer.

For detailed information about delivery, please see our Shipping & Delivery Policy.

8. RETURNS, EXCHANGES AND REFUNDS

Our returns, exchanges and refunds are governed by our Return & Refund Policy.

You can find our Return & Refund Policy here:

Nothing in our Return & Refund Policy or these Terms limits any statutory rights you may have under South African consumer law.

For example, ECTA provides a seven-day cooling-off right for qualifying electronic transactions involving goods, subject to the statutory exceptions.

Consumers may also have additional rights relating to defective or unsafe goods under the Consumer Protection Act.

9. CUSTOMER RESPONSIBILITY

When placing an order, you are responsible for providing accurate information, including:

  • Your name
  • Email address
  • Telephone number
  • Delivery address
  • Product selection
  • Size selection

Soleify cannot be held responsible for delivery problems caused by incorrect information supplied by the customer, subject always to applicable consumer law.

If you realise that you have provided incorrect information, please contact us as soon as possible.

10. INTELLECTUAL PROPERTY

All content appearing on the Soleify website, including where applicable:

You may not reproduce, copy, modify, distribute, sell or commercially exploit our content without our prior written permission.

11. USER CONTENT

If you voluntarily send us photographs, reviews, comments, testimonials or other content, you confirm that you have the right to provide that content to us.

You grant Soleify permission to use such content for legitimate business and marketing purposes where permitted by law.

By using our website, you acknowledge that your personal information may be processed as described in that Privacy Policy and in accordance with applicable South African data-protection law.

13. THIRD-PARTY SERVICES

Our website may use third-party services, including:

  • Shopify
  • Payment providers
  • Courier companies
  • Email providers
  • Analytics services
  • Advertising platforms
  • Other technology providers

Soleify is not responsible for the independent actions, policies or services of third parties, except to the extent required by applicable law.

14. WEBSITE AVAILABILITY

We aim to keep our website available and functioning properly.

However, we cannot guarantee that the website will always be:

  • Available
  • Error-free
  • Secure
  • Free from interruptions
  • Free from technical problems

We may temporarily suspend or modify the website for maintenance, upgrades or other operational reasons.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Soleify will not be responsible for losses arising from circumstances outside our reasonable control.

However, nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited under South African law.

We will not attempt to contract out of statutory consumer protections.

This is important because the Consumer Protection Act prohibits suppliers from imposing terms that are unfair, unreasonable or unjust, including terms that require consumers to waive rights or liabilities that cannot lawfully be waived.

16. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delays or failures caused by circumstances reasonably beyond our control, including where applicable:

  • Natural disasters
  • Severe weather
  • Government action
  • Power outages
  • Internet or telecommunications failures
  • Courier disruptions
  • Strikes
  • Civil unrest
  • War
  • Other events beyond our reasonable control

Where such an event affects your order, we will make reasonable efforts to communicate with you and find an appropriate solution.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The latest version will be posted on our website with the updated "Last updated" date.

Changes will not remove rights that you have already acquired under applicable law or alter an existing transaction unlawfully.

18. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts or other legally available dispute-resolution mechanisms.

19. CONSUMER RIGHTS

Nothing in these Terms is intended to:

  • Remove your statutory rights
  • Exclude consumer protections
  • Prevent you from exercising rights provided by law
  • Require you to waive rights that cannot legally be waived

Where these Terms conflict with a mandatory provision of South African law, the mandatory legal provision will prevail.
